# Terms and Conditions for GlowUp: Skincare Routine

## 1. DEFINITIONS

Service Provider: Adev Technologies, the company that owns and operates the GlowUp application.

Application or App: The "GlowUp: Skincare Routine" mobile application available for iOS and Android devices.

User: Any natural person who downloads the App and creates a User Account.

User Account: The personalized account created by the User to access App features and services.

Services: All features and functionalities provided through the App, including free and premium services.

Premium Subscription: Paid subscription service offering enhanced features and capabilities.

Terms or Terms and Conditions: This document governing the use of the GlowUp application.

Content: Any text, images, photos, data, or other materials posted, uploaded, or stored in the App.

Privacy Policy: The document describing how we collect, use, and protect personal data.

## 2. GENERAL PROVISIONS

### 2.1 Agreement to Terms
By downloading, installing, or using the GlowUp app, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you must not use the App and should immediately uninstall it.

### 2.2 Eligibility

You must be at least 16 years of age to use GlowUp.
- If you are between 16 and 18, you must have parental or guardian consent.

Subject to your compliance with these Terms, Adev Technologies grants you a limited, non-exclusive, non-transferable, revocable license to:

You can manage permissions in your device settings. Denying certain permissions may limit app functionality.

## 4. ACCOUNT REGISTRATION AND SECURITY

To use GlowUp, you must:

- Create a secure password (minimum 8 characters with letters, numbers, and special characters)
- Verify your email address via activation link
- Accept these Terms and the Privacy Policy

You are responsible for:

- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Using a strong, unique password

We are not liable for losses resulting from unauthorized account access due to your failure to maintain security.

- Unlimited product tracking

- Custom reminders and notifications
- Ad-free experience
- Export skincare diary
- Priority customer support

### 5.3 Pricing
Current subscription options:
- Monthly: $4.99/month
- Yearly: $39.99/year (save 33%)

Prices may vary by region and are subject to change with notice.

## 6. IN-APP PURCHASES AND SUBSCRIPTIONS

### 6.1 Purchase Process
- Purchases are processed through Apple App Store or Google Play Store
- We do not handle payment information directly
- You must comply with the terms of the respective app store

### 6.2 Subscription Terms
- Subscriptions automatically renew unless canceled
- Payment is charged to your App Store/Play Store account
- Subscriptions renew 24 hours before the current period ends
- Renewal charges the same price unless you're notified of changes
- Manage or cancel subscriptions in your device settings

### 6.3 Free Trial
If offered:
- Available to new subscribers only
- Converts to paid subscription unless canceled
- Cancel anytime during trial to avoid charges
- One trial per user

### 6.4 Cancellation
To cancel:
- iOS: Settings → Apple ID → Subscriptions → GlowUp → Cancel
- Android: Play Store → Subscriptions → GlowUp → Cancel
- Cancellation takes effect at the end of the current billing period
- No refunds for partial periods

### 6.5 Refund Policy
- All sales are final
- Refunds are handled by Apple App Store or Google Play Store according to their policies
- Contact App Store/Play Store support for refund requests
- We may offer refunds at our discretion for exceptional circumstances

## 7. USER CONDUCT AND PROHIBITED USES

### 7.1 Acceptable Use
You agree to:
- Use the App in compliance with all applicable laws
- Respect the rights and privacy of other users
- Use the App for personal, non-commercial purposes
- Provide accurate information

### 7.2 Prohibited Conduct
You must NOT:
- Use the App for any illegal purpose
- Violate any laws or regulations
- Infringe upon intellectual property rights
- Post offensive, harmful, or inappropriate content
- Harass, abuse, or harm other users
- Spam or send unsolicited communications
- Attempt to hack, reverse engineer, or compromise the App
- Use automated systems (bots) to access the App

- Sell or transfer your account
- Use the App for commercial purposes without authorization

- Remove content that violates these Terms
- Suspend or terminate accounts for violations
- Report illegal activity to authorities

## 8. USER-GENERATED CONTENT

You retain ownership of content you upload (photos, journal entries, reviews), but you grant us certain rights.

By posting content in the App, you grant Adev Technologies a worldwide, non-exclusive, royalty-free license to:
- Store and display your content within the App
- Process your content to provide Services
- Create derivative works for service improvement
- Use anonymized, aggregated data for analytics
- Display your content to other users (where applicable, e.g., reviews)

### 8.3 Content Restrictions
Your content must NOT:
- Violate any laws or third-party rights
- Contain false or misleading information
- Include spam or promotional material (unless authorized)
- Contain offensive, harmful, or inappropriate material
- Include personal information of others without consent

### 8.4 Content Removal
You can delete your content at any time through the App. We will delete it from our servers within 30 days, except:
- Backups (deleted within 90 days)
- Legal requirements
- Aggregated, anonymized data

## 9. INTELLECTUAL PROPERTY RIGHTS

### 9.1 Our Ownership
All rights, title, and interest in the App, including:
- App design, code, and architecture
- Trademarks, logos, and branding
- Content created by Adev Technologies
- Product database and algorithms

are owned by Adev Technologies and protected by copyright, trademark, and other intellectual property laws.

### 9.2 Restrictions
You may NOT:
- Copy, modify, or distribute the App
- Reverse engineer or decompile the App
- Remove copyright or proprietary notices
- Use our trademarks without permission
- Create derivative works
- Sell, rent, or lease the App

### 9.3 Third-Party Content
The App may include:
- Product information from manufacturers
- User reviews and ratings
- Third-party integrations

We respect the intellectual property rights of others and expect users to do the same.

## 10. MEDICAL DISCLAIMER

The App:

- Is not intended to treat, cure, or prevent any disease or condition

### 10.2 Consult Healthcare Professionals
Always consult with qualified healthcare professionals:
- Before starting new skincare routines
- If you have skin conditions (acne, eczema, rosacea, etc.)
- Before using new products, especially if you have sensitive skin
- If you experience adverse reactions
- For medical diagnosis or treatment

### 10.3 Product Information
- Product data is provided for informational purposes
- We do not endorse or guarantee any products
- Product safety and effectiveness are not guaranteed
- Always read product labels and follow manufacturer instructions
- Perform patch tests before using new products

### 10.4 Individual Results
- Results vary based on individual factors
- Skin type, genetics, and lifestyle affect outcomes
- We make no guarantees about results
- Photos and testimonials are not typical results

### 10.5 Liability Disclaimer
We are NOT liable for:
- Skin reactions or adverse effects from products
- Decisions made based on app information
- Reliance on user-generated content
- Delay in seeking medical treatment
- Any health consequences from app use

## 11. LIABILITY AND WARRANTIES

### 11.1 Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Uninterrupted or error-free operation
- Accuracy or reliability of content

### 11.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADEV TECHNOLOGIES SHALL NOT BE LIABLE FOR:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Personal injury or property damage
- Damages resulting from app use or inability to use
- Third-party content or actions
- Security breaches or data loss

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR SUBSCRIPTIONS IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS LESS.

### 11.3 Technical Issues
We are not responsible for:
- Device compatibility issues
- Internet connectivity problems
- Third-party service interruptions
- App Store or Play Store issues
- Force majeure events

### 11.4 Service Availability
We strive for 99.9% uptime but do not guarantee uninterrupted access. We may:
- Perform maintenance (with notice when possible)
- Experience downtime due to technical issues
- Modify or discontinue features
- Update the App regularly

## 12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Adev Technologies, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any laws or third-party rights
- Your content
- Your negligence or misconduct

## 13. TERMINATION

### 13.1 Termination by You
You may terminate your account at any time by:
- Deleting your account in App Settings
- Uninstalling the App
- Emailing support@glowup.adevtech.com

### 13.2 Termination by Us
We may suspend or terminate your account if:
- You violate these Terms
- You engage in fraudulent activity
- You abuse or harass other users
- Required by law
- The App is discontinued

### 13.3 Effects of Termination
Upon termination:
- Your access to the App ends immediately
- Your data will be deleted within 30 days (see Privacy Policy)
- Subscriptions continue until expiration (no refunds)
- Some provisions survive termination (e.g., indemnification, disclaimers)

## 14. PRIVACY AND DATA PROTECTION

- You represent that you're not located in a country subject to U.S. embargo
- You comply with applicable third-party terms

### 19.2 Google Play Store
If you download the App from Google Play Store:
- These Terms are between you and Adev Technologies, not Google
- Google has no obligation to provide support
- Google is not responsible for the App or its content
- You comply with Google Play's terms of service

## 20. ACKNOWLEDGMENT

BY USING GLOWUP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.

YOU ALSO ACKNOWLEDGE THAT GLOWUP IS NOT A MEDICAL APP AND DOES NOT PROVIDE MEDICAL ADVICE.
