# Terms of Service for MelodAI: AI Song & Music Maker

## 1. Acceptance of Terms

By accessing or using MelodAI: AI Song & Music Maker ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

## 2. Description of Service

MelodAI is an AI-powered music generation application that provides:

Text-to-music generation using artificial intelligence
- Music composition, editing, and remixing tools
- Cloud storage for your music creations
- Collaboration and sharing features
- Export and download capabilities

Important: melodAI uses experimental AI technology. Generated music may vary in quality and accuracy.

## 3. User Accounts

### 3.1 Eligibility
- You must be at least 13 years old to use the App
- Users under 18 require parental consent
- You must provide a valid email address
- You are responsible for maintaining account security

### 3.2 Account Security
- Keep your password confidential
- Notify us immediately of unauthorized access: support@adevtech.com
- You are responsible for all activities under your account
- Do not share your account credentials

## 4. Acceptable Use

### You MAY:
- Create music using the AI generation tools
- Use generated music according to your subscription tier
- Share your creations (respecting ownership terms)
- Collaborate with other users
- Export and download your music

### You MAY NOT:
- Use the App for illegal purposes or to create harmful content
- Attempt to reverse engineer, hack, or compromise the App
- Submit copyrighted material without permission (lyrics, melodies, samples)
- Recreate or copy existing copyrighted songs
- Use AI outputs to train competing AI models
- Abuse the service (spam, excessive API calls, automated requests)
- Share your account with others
- Submit prompts containing hate speech, violence, or illegal content
- Impersonate artists or claim AI-generated music was created by someone else

## 5. AI-Generated Music: Ownership & Rights

### 5.1 How AI Works

melodAI uses machine learning models trained on diverse music datasets. Due to the nature of AI:
- Outputs may not be unique - similar prompts may generate similar music
- Quality varies - AI is experimental and results depend on prompt quality
- No guarantee of copyright - we cannot guarantee generated music will be copyrightable or won't conflict with existing works

### 5.2 Ownership of AI-Generated Music

Free Tier Users:
- Non-commercial use only: You may use AI-generated music for personal, educational, or non-commercial projects
- Attribution required: You must credit melodAI when sharing or publishing music
- No commercial rights: Cannot sell, license, or monetize music created on free tier
- Format: "Music generated with melodAI (www.adevtech.com/apps/melodai)"

Premium/Pro Tier Users:
- Full ownership: You own all rights to music generated during your paid subscription
- Commercial use allowed: Use in videos, podcasts, advertisements, games, albums, streaming services
- No attribution required: Attribution appreciated but not mandatory
- Licensing rights: You can license or sell your generated music
- Limitations: Due to AI nature, we cannot guarantee exclusive copyright if similar music is generated for others

### 5.3 Your Prompts & Submissions

By submitting text prompts or uploading content to melodAI, you:
- Grant us permission to process your prompts to generate music
- Grant us a perpetual, worldwide license to use your prompts to train and improve our AI models
- Represent that your prompts do not infringe third-party copyrights
- Understand that prompts may be stored and used for AI training (opt-out available)

Opting Out of AI Training:
- Email support@adevtech.com with subject "Opt Out of AI Training"
- Your future prompts will not be used for training
- Past prompts may already be incorporated into models

### 5.4 Public Sharing & Remixing

If you choose to make tracks public:
- Other users can listen and download your music
- If enabled, other users may remix your tracks
- Remixes are considered derivative works co-owned by you and the remixer
- You cannot retract public tracks, but you can delete them

Default Setting: All tracks are private unless you explicitly make them public.

## 6. Subscription and In-App Purchases

### 6.1 Free Tier
- Limited music generation (e.g., 10 tracks per month)
- Basic features
- Non-commercial use only
- Attribution required

### 6.2 Premium/Pro Tier (In-App Purchase)
- Unlimited music generation
- High-quality audio export (WAV, FLAC)
- Commercial use rights
- Offline mode
- Priority support
- Advanced features (vocals, longer tracks, custom instruments)

### 6.3 Pricing and Payment
- Prices displayed in the App and App Store/Play Store
- Payment processed by Apple or Google
- We do NOT have access to your payment information
- Subscriptions auto-renew unless cancelled

### 6.4 Cancellation and Refunds
- Cancel anytime through your App Store/Play Store account
- Refunds subject to Apple/Google policies
- Contact support@adevtech.com for refund requests
- No refunds for AI-generated music you've already downloaded

### 6.5 Auto-Renewal
- Premium subscriptions automatically renew
- You will be charged 24 hours before renewal
- Manage subscriptions in device settings:
- iOS: Settings → [Your Name] → Subscriptions
- Android: Google Play → Subscriptions

Downgrading: If you cancel, you retain Premium benefits until subscription period ends. After that, commercial use rights no longer apply to new music (existing music retains rights when created).

## 7. Intellectual Property

### 7.1 The App
- melodAI, its design, and AI models are owned by Adev
- You are granted a limited, non-exclusive, non-transferable license to use the App
- You may not copy, modify, reverse engineer, or create derivative works of the App

### 7.2 User-Generated Music
- Premium users: You own AI-generated music created during subscription
- Free users: Non-commercial, personal use only with attribution
- Our license: We retain a license to display publicly shared tracks within the App

### 7.3 Third-Party Content
- You may not upload copyrighted samples, melodies, or lyrics without permission
- Violations may result in account termination
- We comply with DMCA takedown requests

## 8. Copyright Infringement

### 8.1 DMCA Compliance
If you believe content on melodAI infringes your copyright:

Subject: "DMCA Takedown Request"
Include:
- Your contact information
- Description of copyrighted work
- URL or description of infringing content
- Statement of good faith belief
- Statement made under penalty of perjury
- Your physical or electronic signature

We will investigate and remove infringing content within 48 hours.

### 8.2 Repeat Infringers
Accounts with multiple copyright violations will be terminated.

## 9. Privacy and Data

### 9.1 Data Collection
- We collect email, name (optional), text prompts, and generated music
- All data stored securely in Firebase
- We do NOT collect usage data, device information, or location

### 9.2 AI Training
- We may use your prompts to train AI models (you can opt out)
- Generated music may be referenced to improve our models
- All sensitive data is anonymized

### 9.3 Data Deletion
- Delete your account anytime: Settings → Account → Delete Account
- Visit: https://adevtech.com/apps/melodai/request-delete
- Or email: support@adevtech.com
- All data permanently removed within 30 days

## 10. Disclaimers and Limitations

### 10.1 "AS IS" Basis
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, including but not limited to:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Uninterrupted or error-free operation
- Accuracy or quality of AI-generated music
- Copyright protection of generated music

### 10.2 AI Limitations
- AI is experimental - generated music quality varies
- No uniqueness guarantee - similar prompts may produce similar outputs
- No copyright guarantee - we cannot ensure generated music is copyrightable
- Potential infringement - AI may inadvertently generate music similar to existing works
- No human review - AI outputs are not reviewed before delivery

### 10.3 Limitation of Liability
To the maximum extent permitted by law, Adev shall NOT be liable for:
- Loss of data, revenue, or profits
- Indirect, incidental, or consequential damages
- Copyright infringement claims arising from AI-generated music
- App downtime or technical issues
- Third-party service interruptions (Firebase, App Stores)
- Quality or usability of AI-generated music

Maximum Liability: Our total liability shall not exceed the amount you paid in the last 12 months (if any), or $100, whichever is greater.

## 11. Third-Party Services

The App relies on the following third-party services, each governed by their own terms:

- Firebase (Google LLC) — Authentication, data storage, and analytics
- Suno AI (Suno, Inc. — suno.com) — AI music generation, audio processing, stem separation, and mashup services. When you upload audio, record audio, or submit prompts for music generation, this data is transmitted to Suno AI for processing. By using these features, you consent to Suno AI's terms of service and privacy policy.
- Google Gemini (Google LLC) — AI-powered lyrics generation
- Apple App Store / Google Play Store — Payment processing and distribution

We are not responsible for the practices of these third-party services. We encourage you to review their respective privacy policies and terms.

## 12. Termination

### 12.1 By You
- Stop using the App at any time
- Delete your account: Settings → Account → Delete Account

### 12.2 By Us
We may suspend or terminate your account if:
- You violate these Terms
- You infringe copyrights repeatedly
- You abuse the service (spam, hacking attempts)
- Required by law
- The App is discontinued (with 30 days notice)

### 12.3 Effect of Termination
- Your access to the App will be revoked
- Your data will be deleted according to our Privacy Policy
- Premium subscriptions may be cancelled (no refund unless required by law)
- Music rights: Music created during Premium subscription retains commercial rights even after termination

## 13. Changes to Terms

- We may update these Terms from time to time
- Changes will be communicated via email or in-app notification
- Continued use after changes constitutes acceptance
- Material changes will require explicit consent

## 14. Governing Law

- These Terms are governed by the laws of your jurisdiction
- Disputes will be resolved in accordance with applicable consumer protection laws
- EU users have rights under GDPR and applicable consumer laws
